Please review your order carefully before submitting, as MŌTTUS may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by MŌTTUS, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

MŌTTUS is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MŌTTUS. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MŌTTUS, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MŌTTUS.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

You agree to indemnify, defend and hold harmless MŌTTUS, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where MŌTTUS is headquartered. You and MŌTTUS consent to venue and personal jurisdiction in such courts.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

ADDITIONAL INFORMATION FOR EUROPEAN UNION CUSTOMERS

TERMS AND CONDITIONS OF THE ONLINE STORE

The owner of the online store MŌTTUS (hereinafter referred to as the Online Store) is OÜ MMDisainimaja (registry code 17314275), located at Kuigatsi Külamaja, 68222 Kuigatsi, Valgamaa, Estonia.

Validity of the Sales Contract, Product and Price Information

These terms and conditions apply to purchases made from the Online Store.

The prices of products sold in the Online Store are indicated next to the products. A fee for delivery of the goods is added to the price. All prices of goods sold in the Online Store are displayed in euros.

The delivery fee depends on the buyer's location and the chosen delivery method. The delivery fee is displayed to the buyer during the ordering process.

Information about the products is provided directly next to the products in the Online Store.

Placing an Order

To order goods, the desired products must be added to the shopping cart. To complete the order, the buyer must fill in the required information fields and select a suitable delivery method.

The amount payable will then be displayed on the screen, and payment can be made securely using the following payment methods:

  • Bank payments through Maksekeskus AS;

  • Visa/Mastercard card payments;

  • Apple Pay and Google Pay;

  • PayPal;

  • Other payment methods available during checkout.

When paying via a bank link, the buyer must make sure to click the button "Return to Merchant" on the bank's page after completing the payment.

Payments are processed by Maksekeskus AS when Maksekeskus payment methods are used. Payment takes place outside the Online Store in a secure environment – when paying via a bank link, in the secure environment of the respective bank, and when paying by card, in the secure environment of Maksekeskus AS.

The seller does not have access to the customer's bank or payment card details.

The contract enters into force after the amount due has been received into the Online Store's bank account.

The owner of the Online Store is the controller of personal data and transfers the personal data necessary for payment processing to Maksekeskus AS as an authorised processor.

If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be informed as soon as possible and the money paid will be refunded (including delivery costs) without delay, but no later than within 14 days from sending the notification.

The shipping costs are paid by the buyer, and the relevant price information is displayed next to the delivery method.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than necessary to establish the nature, characteristics, and functioning of the goods in the same manner as the buyer would be allowed to test the goods in a physical store.

If the goods have been used for purposes other than those necessary to establish their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.

To return goods, the buyer must submit a withdrawal statement and send it to the email address contact@mottus.co no later than 14 days after receiving the goods.

The buyer shall bear the costs of returning the goods, except where the reason for the return is that the delivered product does not correspond to the order (for example, the wrong or defective product).

The buyer must return the goods within 14 days after submitting the withdrawal statement or provide proof that the goods have been handed over to the carrier within the aforementioned period.

The Online Store shall refund the buyer all payments received from the buyer under the contract without undue delay, but no later than within 14 days from receiving the withdrawal statement.

The Online Store may refuse to make the refund until it has received the goods subject to the contract or until the buyer has provided evidence that the goods have been returned, whichever occurs first.

If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund the cost exceeding the cost of the standard delivery method.

Right to Submit Complaints

The Online Store is responsible for the non-conformity of the goods sold to the buyer with the terms of the contract or for defects that existed at the time of delivery of the goods and that become apparent within two years from the delivery of the goods to the buyer.

Within one year from the delivery of the goods to the buyer, it is presumed that the defect existed already at the time of delivery of the goods. Refuting this presumption is the responsibility of the Online Store.

If a defect becomes apparent, the buyer has the right to contact the Online Store no later than within two months by sending an email to contact@mottus.co

The Online Store is not responsible for defects that have arisen after the goods have been delivered to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods.

If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.

The Online Store will respond to a consumer complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer only for processing the order and delivering the goods to the buyer.

The Online Store transfers personal data to companies providing delivery services in order to deliver the goods.

The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a desire to receive such communications by entering their email address on the website and giving consent to receive direct marketing messages.

The buyer can unsubscribe from email offers and newsletters at any time by notifying the Online Store by email or by following the instructions provided in the marketing email.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they must be sent to the email address contact@mottus.co.
